Ethical Duties to Our Clients and to Others For Legal Advice and Legal Opinions
The panel will explore ethical obligations lawyers have for advice to their own clients and when bad advice to clients leads to liability. The panel also will explore how the duties and potential liability changes if a third party relies on the advice. Recognizing that the circumstances matter, the panel will discuss oral versus written advice, and whether calling something an “opinion” instead of a memorandum matters. The panel also will discuss the extent to which law firm policies and procedures applicable to third party legal opinions should apply in other contexts.
